Terms of Service

1. Acceptance of Terms
SnapOS is a cloud-based point-of-sale platform published, owned, and operated by Zetran Corporation ("Zetran Corporation", "we", "us", "our"), a company registered in Delaware, USA, with its principal office at 225 Cedar Hill Street, Suite 200, Marlborough, MA 01752, USA.
If you use SnapOS on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you and that entity.
2. The Service
SnapOS provides point-of-sale, inventory, staff, customer, and reporting tools accessible through our mobile app, web app, and an optional customer-facing online storefront (collectively, the "Service"). We may add, change, or remove features at any time as the Service evolves.
We may suspend or limit access to the Service, in whole or in part, for scheduled maintenance, security reasons, or to comply with legal obligations, and will make reasonable efforts to give advance notice where practical.
3. Accounts & Eligibility
You must be at least 18 years old and able to form a binding contract to create a SnapOS account. You are responsible for:
- The accuracy of the business and account information you provide
- Safeguarding your password, PIN, and any staff credentials issued under your account
- All activity that occurs under your account, including actions taken by staff you authorize
- Promptly notifying us at support@snapos.app of any unauthorized use
Admin accounts may create staff accounts with limited roles (Admin / Staff) and are responsible for managing staff access and revoking it when appropriate.
4. Subscriptions, Billing & Trials
SnapOS offers a free tier and paid subscription plans, as described on our Pricing page or in your account's billing settings. Paid plans may be billed as a flat recurring subscription or as per-terminal / per-seat pricing, depending on the plan.
- Payments are processed by third-party payment processors — currently Stripe and Razorpay — and are subject to those providers' own terms
- Where a free trial is offered, it will convert to a paid subscription at the price and interval shown at signup unless you cancel before the trial ends
- Subscriptions renew automatically for successive billing periods until cancelled
- You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period
- Fees already paid are non-refundable except where required by law
- We may suspend or downgrade access if payment fails and is not resolved within a reasonable cure period after notice
Enterprise plans with custom pricing are governed by the order form or separate agreement you sign with us, which takes precedence over this section in case of conflict.
5. Acceptable Use
You agree not to use SnapOS to:
- Violate any applicable law, including tax, consumer protection, or payment-processing regulations
- Process payment card data outside the mechanisms we provide, or attempt to circumvent our payment processors
- Upload malware, attempt to breach security, or interfere with other businesses' data on the platform
- Sell counterfeit goods, stolen goods, or items prohibited under our payment processors' acceptable-use policies
- Impersonate another business or person, or misrepresent your affiliation with anyone
- Reverse-engineer, scrape, or resell access to the Service without our written consent
We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.
6. Your Content & Data
You retain ownership of the data you put into SnapOS — your product catalog, order and customer records, images, and other business content ("Your Content"). We do not claim ownership over it.
By uploading Your Content, you grant Zetran Corporation a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display it solely as necessary to provide and support the Service to you (for example, rendering your catalog on your storefront, or generating your reports). This license ends when you delete the content or close your account, subject to routine backup retention as described in our Privacy Policy.
You are responsible for having the necessary rights to any content you upload (e.g. product photos, logos) and for the accuracy of the data you enter, including pricing and tax information.
7. Online Storefront
If you enable the SnapOS online storefront, you are acting as the merchant of record for sales made through it. You are responsible for complying with applicable consumer protection, e-commerce, and tax laws in the jurisdictions you sell into, including any required disclosures, return policies, and tax collection and remittance.
SnapOS provides the platform and checkout infrastructure but is not a party to the sale contract between you and your customers.
8. Intellectual Property
The SnapOS platform, including its software, design, trademarks, and logos, is owned by Zetran Corporation and protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use SnapOS for your internal business purposes.
You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer it, except as permitted by law.
9. Third-Party Services
SnapOS relies on third-party providers to operate, including Amazon Web Services (hosting and file storage), Stripe and Razorpay (payment processing), and email delivery providers. Your use of features backed by these providers is also subject to their respective terms. We are not responsible for outages or errors originating from third-party providers, though we will make reasonable efforts to work around them.
10. Service Availability
We aim to keep SnapOS available and reliable at all times but do not guarantee uninterrupted or error-free operation for Starter or Growth plans. Enterprise plans with a written service-level agreement receive the uptime commitment stated in that agreement (currently advertised as a 99.9% monthly uptime target on our Pricing page); remedies for missing that target are as set out in the applicable order form.
11. Disclaimer of Warranties
Except as expressly stated in a written agreement between you and Zetran Corporation, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any data loss will not occur.
12. Limitation of Liability
To the maximum extent permitted by law, Zetran Corporation's total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us for the Service in the three (3) months preceding the claim. In no event will Zetran Corporation be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold Zetran Corporation harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.
14. Termination
You may stop using SnapOS and close your account at any time from your business settings, or by requesting deletion as described on our Data Deletion page. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if required by law.
Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — will survive.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will first be pursued through good-faith informal resolution. If unresolved, the dispute will be settled by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, conducted by a single arbitrator, with judgment on the award enforceable in the state and federal courts located in Delaware. You and Zetran Corporation each waive the right to a jury trial and to participate in a class action. Either party may bring an individual claim in small-claims court where eligible.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where the change materially reduces your rights, notify account holders by email at least 14 days before the change takes effect. Continued use of SnapOS after the effective date constitutes acceptance of the updated Terms.
